GIFT CERTIFICATE TERMS & CONDITIONS

By purchasing, accepting, or redeeming a Windy Sol Photography gift certificate, the purchaser and recipient acknowledge and agree to the following terms and conditions.

1. Redemption - Gift certificates are redeemable exclusively for photography services provided by Windy Sol Photography and may be redeemed only for the session or photography service identified on the certificate, subject to the terms below. Gift certificates have no cash value, are not redeemable for cash, and may not be exchanged for cash except where otherwise required by applicable law.

2. Validity & Expiration - Gift certificates are valid for five (5) years from the date of issuance. The expiration date will be stated on the gift certificate.The photography session must take place on or before the expiration date. Recipients are encouraged to contact Windy Sol Photography well in advance of the expiration date to allow sufficient time for scheduling, as availability is not guaranteed for any particular date, season, or time of year. Failure to schedule sufficiently in advance does not extend the expiration date.

3. Session Included - A gift certificate purchased for a specific photography session entitles the recipient to the session and standard inclusions identified on the certificate, subject to these Terms & Conditions. If Windy Sol Photography increases the regular price of that session after the gift certificate is purchased, the recipient will not be required to pay the difference solely because of the price increase, provided the certificate is redeemed for the session originally purchased. If the session identified on the certificate is discontinued or materially changed before redemption, Windy Sol Photography will honor the original value paid toward a currently offered photography service. If the recipient selects a service priced higher than the value originally purchased, the recipient will be responsible for the difference. Any optional upgrades, additional images, products, extended session time, travel fees, location fees, permits, or other services not specifically included with the original gift certificate are the responsibility of the recipient.

4. Scheduling & Availability - Gift certificates do not guarantee availability for a particular date, time, location, season, event, or holiday. All sessions are subject to Windy Sol Photography's current availability and booking calendar. Recipients should contact Windy Sol Photography as early as possible to schedule their session. A gift certificate does not reserve a session date. A date is considered reserved only after the recipient has completed Windy Sol Photography's required booking process, including execution of the applicable photography agreement.

5. Session Policies - Redemption of a gift certificate is subject to Windy Sol Photography's standard session agreement and policies in effect at the time the session is booked, including policies concerning scheduling, rescheduling, cancellations, weather, tardiness, locations, image delivery, artistic discretion, and client conduct. The recipient must complete and sign the required photography agreement before the session takes place. Once a gift certificate has been redeemed and a session has been scheduled, cancellation and rescheduling will be governed by the photography agreement applicable to that booking.

6. Retainer - If the gift certificate states that it includes the session's required retainer, no additional retainer will be required to reserve the session. If the certificate does not include the required retainer, any applicable booking requirements will be disclosed to the recipient before scheduling. No inactivity, dormancy, maintenance, or redemption fee will be deducted from the value of a gift certificate.

7. Additional Images & Products - Unless otherwise stated on the gift certificate, the certificate includes only the number of digital images, products, or other deliverables ordinarily included with the session identified on the certificate. Additional images, prints, albums, products, upgrades, or other optional purchases are not included and may be purchased separately at the pricing in effect when those additional items are ordered.

8. Travel & Locations - Unless specifically stated otherwise, gift certificates are intended for sessions taking place within Windy Sol Photography's standard service area. Travel outside the standard service area, admission charges, photography permits, studio rentals, venue fees, or other third-party costs may require an additional charge and are not included unless expressly stated on the certificate.

9. Transfers - Gift certificates may be given or transferred to another person prior to redemption. Resale of a gift certificate is prohibited.

The holder of the gift certificate is responsible for providing the certificate number or other identifying information requested by Windy Sol Photography when redeeming it.

10. Lost or Stolen Certificates - Gift certificates should be treated like cash. Windy Sol Photography is not responsible for lost, stolen, destroyed, or improperly transferred certificates. When sufficient purchase records are available to verify an unused certificate and its remaining value, Windy Sol Photography may replace the certificate at its discretion and in accordance with applicable law.

11. Refunds - Gift certificate purchases are final and non-refundable except where a refund is required by applicable law. A recipient's inability to use the certificate on a preferred date, with a preferred seasonal setting, or at a preferred location does not entitle the purchaser or recipient to a refund.

12. Promotions & Discounts - Unless expressly stated otherwise, gift certificates may not be combined with promotional offers, discounts, giveaways, mini-session promotions, or other certificates. A gift certificate purchased at full value will retain the service or value to which the holder is legally entitled and will not be reduced by an inactivity, service, or dormancy fee.

13. Photographer Availability or Business Closure - If Windy Sol Photography is permanently unable to provide the photography services represented by an outstanding gift certificate, the certificate will be handled in accordance with applicable New Mexico and federal law.

14. Governing Law - These Terms & Conditions are governed by the laws of the State of New Mexico. Nothing in these Terms & Conditions is intended to waive, limit, or restrict any consumer right that cannot lawfully be waived under New Mexico or federal law.

15. Acceptance of Terms - Purchase, acceptance, or redemption of a Windy Sol Photography gift certificate constitutes acknowledgment of these Terms & Conditions. Gift certificate terms are subject to applicable law. Where these Terms & Conditions conflict with a non-waivable requirement of applicable law, the applicable law will control.
